Eastbourne restaurant and takeaway secures late night licence

An Eastbourne restaurant and takeaway has been granted late opening hours and a new premises licence.

Following a hearing earlier this month, Chef H Fast Food Factory in Langney Road has been granted a licence to open until 1am on Friday and Saturday nights.

The restaurant will also be able to open until midnight between Monday to Thursday and to serve alcohol until 11pm, as long as it is consumed off-site.

It had originally applied for licence to serve food until 4am from Monday to Saturday, but concerns were raised by both Sussex Police and Eastbourne Borough Council’s licensing team due to the restaurant falling within the town’s cumulative impact zone.#

Eastbourne takeaway reduces proposed late opening hours

While representatives of the restaurant proposed some changes and extra conditions to overcome these concerns – including a 3am closing time on Fridays and Saturdays – a council licensing sub-committee ultimately decided on greater restrictions.

In a decision notice, a council licensing spokesman said: “The sub-committee noted that the premises were in the cumulative impact zone and the rebuttable presumption that this application for a new premises licence should be refused. 

“However, the members were content on this occasion to grant the licence, subject to the revised hours and the modified conditions, on the basis that the applicant had now demonstrated that the premises would not add to the cumulative impact in the area and would not undermine the promotion of the licensing objectives.

“The sub-committee noted the objections particularly of the local residents and the police which centred around the late hours originally applied. 

“On that basis it considered that a reduction in the licensable hours for late night refreshment would be an appropriate and proportionate step to take which would adequately address those concerns.”
