A divorce lawyer from Eastbourne has given X Factor judge Cheryl Fernandez-Versini some advice on her rumoured split – through the columns of a celebrity gossip magazine.
The former Girls Aloud star has reportedly “filed for divorce” from French husband Jean-Bernard citing irreconcilable differences and there has also been a rumour she may have to wait until 2017 to end her brief marriage because of where they tied the knot.
But Eastbourne family lawyer Paul Summerbell is this week quoted in celebrity online magazine OK saying the star is eligible to divorce in the UK regardless of marrying Jean-Bernard on the Caribbean island of Mustique.
Speaking to OK! Online, Paul Summerbell, a leading family lawyer from Warren’s Law and Advocacy in Eastbourne’s Gildredge Road, said it doesn’t matter where the singer was married.
“They can get divorced in the UK regardless of where they were married,” said Paul. “It doesn’t matter.”
He said Cheryl is eligible to file for divorce in the UK, as she’s a “habitual resident” of the country.
“She can present her position to the UK courts, if she’s got a domicile here or if she’s been habitually resident in the United Kingdom,” the lawyer said.
It comes after reports claimed that the singer would have to wait until July 2017 to separate from her husband because of laws on the island where they tied the knot.
The report claimed that strict laws on the island meant amicable divorces were very unlikely to be considered.
According to reports, the singer will be keeping her current surname of Fernandez-Versini following the split.
