A Hailsham man is one of almost 200 people to have secured a settlement worth hundreds of thousands of pounds against a cruise company after a holiday from hell.

Peter Knights booked a trip aboard the Island Escape cruise ship, which visits places such as Morocco, Gibraltar, Madeira and Las Palmas, but like many others, was shocked by the ‘atrocious conditions’ they were faced with.

The ship had many blocked toilets, which resulted in urine overflowing onto the floors, and guests were often served food that had been left out for long periods of time. The conditions led to many passengers falling ill with stomach cramps and severe sickness.

Travel lawyers from Irvin Mitchell representing the passengers who travelled on board the luxury cruise liner issued court proceedings against Sunshine Cruises Limited, TUI UK Limited and First Choice Holidays & Flights Limited following liability being denied. While liability has not formally been admitted, a settlement of several hundred thousands pounds has been agreed for the unfortunate passengers whose holidays were ruined.

Elizabeth Tetzner, a travel law expert from Irwin Mitchell, said, “Aside from making the cruise extremely unpleasant, the types of illness these passengers suffered can have a debilitating long term impact on their health. Some passengers had to seek medical assistance on board the cruise ship, while others had to seek medical assistance upon return home.

“Within the group who travelled on board the cruise ship in 2009 and 2010 were passengers who were looking to enjoy Christmas, wedding anniversary celebrations and birthday celebrations. Those passengers have described to us how these special occasions were ruined by the illness suffered or by the experiences they suffered on board the cruise ship.

“We hope that now a settlement has been reached they will be able to get on with their lives and put the experience behind them.”
