Chris Poole murder, tribute near Premier Foodstore in Hampden Park. August 23rd 2012.E34051N
The jury sitting in the Christopher Poole murder trial have been shown CCTV footage from the night he was attacked.
The group of seven women and five men were shown the footage of inside the Premier shop in The Hydneye, Hampden Park, which showed a man entering the store and disappearing outside with a bottle of water from the shop.
Christine Laing QC, defending a youth who cannot be named because of his age, said the image was of the boy’s father who had taken the water outside to pour over Mr Poole in a bid to wake him up.
Shane Noble, 19, of no fixed address, and a 15-year-old boy who cannot be named due to his age, both deny 46-year-old Mr Poole’s murder.
Yesterday (Monday), as the trial entered its third week, the jury were taken through the CCTV of the night of August 16 last year.
Mr Poole, of Iden Street, is alleged to have been attacked following a dispute over his dogs which had been tied up outside the Premier store.
The court has heard how a member of one of a group of youths had roller-skated past the dogs which then went to attack him. Mr Poole came out of the shop and told them to stay away from the dogs and got into a ‘bit of an argument’ with the 15-year-old defendant and walked away, but came back when one of the group shouted abuse at him. During his evidence a witness said Mr Poole believed it was the 15-year-old defendant who had shouted it but was mistaken. The youth’s brother then shouted at the top flat asking for Noble to come down, stating the youth was about ‘to have a fight’.
The witness told how Noble then punched Mr Poole in the face before the younger defendant punched him to the side of the face.
The boy told the court as Mr Poole started to get back up Noble kicked him to the side of the head.
An ambulance and paramedic arrived to revive Mr Poole but he had suffered severe damage to the artery between his neck and brain and died the next day.
The prosecution is set to finish today (Tuesday) with the defence opening later on the same day.
The trial continues.
