Hotelier fined for noise nuisance

A LOCAL hotelier has lost an appeal after claiming he was not responsible for causing a noise nuisance.

Joe Hayler, the owner of the Vernon House Hotel, appealed against an abatement notice served by Eastbourne Borough Council after ‘excessive noise’ was heard coming from the hotel terrace in the early hours of Sunday, September 11.

The serving of the notice followed a long history of noise complaints about the Vernon House Hotel from nearby residents. Subsequent meetings to try to resolve the problem between council officers and Mr Hayler proved unsuccessful.

The appeal was held at Hastings Magistrates’ Court on Monday May 14 and heard evidence in support of the council’s case from the noise pollution team and two residents who live in neighbouring homes.

The court accepted the evidence that a statutory nuisance had occurred on the night in question, that the noise from the terrace had caused unreasonable disturbance and that the notice should be upheld.

Mr Hayler was ordered to pay £1,500 towards the council’s costs.
