Ban after Hailsham driver throws breath test kit in road
A HAILSHAM man has been given a 12-month driving ban after throwing a police breath test kit in the road.
At Eastbourne Magistrates' Court, on Wednesday (August 25), Dean Handoll, 36, from London Road, pleaded guilty to failing to provide a specimen for analysis.
He pulled into a lay-by on the A22 outside Polegate on the evening of August 15, when he was stopped by police who asked him to provide a roadside breath sample.
The court heard how Handoll threw the breath test kit on the road and was taken into custody, where he also refused to provide a blood sample.
Defending, Noelle Magennis said her client had tried to provide a breath test but his asthma had kicked in.
He then became angry after the officer had said the test was so simple that even a child could do it, she said.
"His younger sister had died of pneumonia and he takes this comment to heart," she told magistrates.
The defendant was fined 100 and also ordered to pay 85 in court costs, as well as a 15 victim surcharge.
